Confiscation and Restraint - POCA [Proceeds Of Crime Act]
In some circumstances the Crown Prosecution Service may seek to confiscate money or property from you, which they consider to be proceeds of crime, by referring to the Proceeds of Crime Act [POCA] 2002.
This applies if you are seen to be in possession of assets that the authorities suspect to have arisen out of criminal wrong doing.
This could be the case if you have been convicted of a criminal offence, but it could also apply even if you have not been convicted (an example could be where a husband is convicted of an offence and his wife owns or co owns their house).
